When Does Student Loan Default Happen
Default is when a loan isnât paid according to the terms of the loan. There is a difference between a student loan that is delinquent and one that is in default. A student loan is delinquent as soon as a monthly payment is past due, but is not necessarily in default. If the borrower continues defaulting on payments, then the student loan will go into default.
The number of days of non-payment for a student loan to move into default depends on the type of loan you received and the terms of your loan. Many federal student loans are considered in default after 270 days of missed payment. Some private student loans consider a loan in default after 90 days of missed payments. Your loan servicer can give you the details about your student loan.

Federal Student Loan Rehabilitation
If Consolidation doesnt seem like the best option for you, dont worry, because there are other ways to get your loans out of Default status, and one of the best ways is via a process called Rehabilitation.
Rehabilitation does take longer than consolidation, and you can only do it once, but it is a great option for anyone where consolidation isnt going to be a good idea.
Just remember that because youre limited to using Rehabilitation once, that you need to take the process seriously, and that itd be a terrible idea to squander it by rehabilitating your loan, then allowing it to go into delinquency again.

Dealing With Private Loans
Unfortunately, resolving a defaulted private loan can be a little bit more difficult. Even though the loans were used for educational expenses, private lenders do not have the same regulations that federal lenders do. Federal lenders are required to have default recovery programs, which is why loan rehabilitation and consolidation are recommended so often.
If you have private loans I encourage you to be exceptionally careful to keep them from going into default. I also discourage you from combining your private and federal loans. Some borrowers will do this through a refinancing process in order to get a lower interest rate. However, once all of your loans are refinanced through a private lender you no longer have access to any of the benefits from a federal loan.
One important distinction for private loans is that they will go into default as soon as you have one missed payment. They do not have an option to move to delinquency status for 9 months like federal loans. If you miss a payment it is important to reach out to your lender as soon as possible. Some private lenders do have programs to help you get back on track, but those options usually expire after 120 days. Then, the defaulted loan is typically moved to a collection agency where they will begin their processes for recovering the funds.
Why It’s Crucial To Get Out Of Default
It’s natural to feel ashamed or uneasy when you miss one or more student loan payments. But you shouldn’t just avoid your loans your best bet is to address the situation as soon as possible.
While student loan default has far-reaching repercussions, there are multiple ways to regain control of your finances, especially if you have federal loans. The sooner you decide to get out of default, the sooner you can improve your credit and move toward a loan-free life.

Student Loan Delinquency Vs Default
A student loan is viewed as delinquent when the borrower does not make a payment by the due date. Most lenders report delinquency to credit bureaus when the loan is 30 or more days past due.
Serious delinquent loan occurs when the borrower is 90 or more days past due. Serious delinquency indicates a significant likelihood that the borrower will default on the loan.
A student loan is considered to be in default when the borrower fails to make a required loan payment for an extended period. Federal student loans go into default when they are 270 days delinquent. Private student loans are in default when they are 120 days delinquent.
Not every delinquent loan will progress to a default. For example, about two-thirds of borrowers who are 31-90 days delinquent on federal student loans will progress to a 91-180 day delinquency. About two-thirds of those will proceed to a 181-270 day delinquency.
About two-thirds of those borrowers will go into default. Ultimately, about a quarter of federal student loan borrowers with a 31-90 day delinquency will eventually default on their student loans.
Federal student loans report defaults as part of a cohort default rate. The cohort default rate is a short-term default rate measure. It reports the percentage of borrowers entering repayment in one federal fiscal year who default by the end of the second following federal fiscal year.

What Happens If Your Student Loan Is Delinquent
Being delinquent on a student loan isn’t the worst thing. Your loans aren’t sent to a collection agency. So you don’t have to worry about wage garnishment or tax refund and Social Security offset. And you’re still eligible for loan forgiveness and to get new federal student aid .
You do, however, run the risk of having negative information sent to the credit bureaus. I’ll dive deeper into the impact on your credit score below, but for now, just know that messing up your credit score is about the worst thing that can happen when you’re delinquent.
The Time Period Of Delinquency
In contrast, default status usually triggers the remainder of your loan balance to be due in full as in requiring the rest of the loan that is due to be paid in whole to complete the loan and unable to resume payments by clearing that which is already due since the time period of delinquency, ending the typical installment payments that were outlined in the original loan agreement.
Rescuing and resuming the loan agreement is most often difficult but not impossible which we will discuss further ahead.
When youre in delinquency, your student loan servicer will be obliged to send you a notice if youre more than 15 days late on your payment.
Being late on a payment once or twice wont make such a dramatic impact on your financial situation right away, but it can and most probably will impact your student loan credit score.

You Still Need To Stay Current On Student Loan Payments
Despite the good news, student loan borrowers should be aware: CAIVRS or the Credit Alert Verification Reporting System could still hold them back from getting a mortgage.
CAIVRS shows if a person is late or in default on a federal debt including student loan payments. If they are and have had late payments on their federal student loans, theyll be automatically disqualified from getting an FHA mortgage entirely, no matter how low their monthly payments may be.
If you are looking to get an FHA loan, you cannot be delinquent. You cannot be late, Simental said. You cannot owe money to them because it automatically disqualifies you.
If you are found in CAIVRS and are behind on a federal debt, you have three options:
- Negotiate a settlement with your loan servicer
- Apply for loan consolidation
- Enter a loan rehabilitation program
According to Simental, loan consolidation can take anywhere from two to three months, while rehabilitation can take as long as 12 months.

In fact, before your loans go delinquent, its a good idea to aggregate all this information so that youll always be fully informed about the state of your debt. Check out the National Student Loan Data System, collect up all your information, and write it down somewhere so you can refer to it again later.
