The multifamily market ended the 2019 year on a high note. Despite increased levels of new units entering the market, the apartment sector maintained strong and steady growth throughout the year. Vacancy rates throughout the country remained fairly stable, easing investors concerns of a significant decline in occupancy due to the high sum of multifamily units delivered. Furthermore, rent growth on the national and metropolitan levels remained healthy throughout the year. While 2019 rent growth was more modest than 2018, it was in line with 2016 and 2017 levels and remained above the national historic average of 3.4%. Based on data provided by the U.S. Census Bureau, multifamily completions increased slightly in 2019 when compared with 2018. The data also show that reported permit growth has increased 3% and starts are up 2%. Based on 2019 data, these metrics suggest that the supply will remain elevated over the next few years. In terms of multifamily mortgage origination, the most up to date information has surpassed expectations. Mortgage Bankers Association reported that the 2018 mortgage volume came in at about $339 billion, an increase of 18.9% from 2017. While the actual 2019 numbers will not be available until later this year, experts estimate that due to solid fundamentals, low interest rates and heightened demand for multifamily investments, the total apartment loan origination volume last year was about $369 billion.

If The Lender Asks For A Security Agreement

If the lender asks for security in return for the loan, they may ask for a security agreement. This is a written assurance of your intention to grant a security interest to the lender.

A security agreement should include:

  • a description of the collateral

  • the amount of the loan being secured

  • a list of what constitutes default

  • the lenders options if the borrower defaults

Other steps the lender may take to protect their security

  • it includes specific descriptions of the collateral

  • you have signed it

The tax code provides a couple notable exceptions to the imputed interest rules:

  • Gift loans of less than $10,000 are exempt, as long as the money isn’t used to buy income-producing assets.
  • Compensation-related and corporation-shareholder loans under $10,000 are also exempt if the lender can demonstrate that tax avoidance wasn’t the purpose of the loan.

Loans “without significant tax effect” are also exempt. The IRS provides several examples in Publication 550, which describes sources of taxable income. Such loans include, among others:

  • Government-subsidized loans, like student loans
  • Loans provided by a lender to the general public that are consistent with the lender’s normal business practices
  • Loans to help an employee relocate
  • Loans from a non-U.S. citizen that wouldn’t otherwise be subject to U.S. tax law

There is a window closing June 30th on prescribed rate loan planning. On July 1, 2022, the CRAs prescribed rate of 1% for family income-splitting loans will rise to 2%, and may continue to rise in the quarters and years ahead. But if you act quickly, you can still lock in the current 1% prescribed rate and potentially save thousands on your tax bill.

Income splitting transfers income from a high-income family member to a lower-income family member. With Canadas graduated tax rates, the overall tax paid by a family is reduced when income is taxed in a lower-income earners hands.

Family income splitting using prescribed rate loans allows you to take advantage of an exception to the CRAs attribution rules and can effectively lower your familys annual tax bill on investment income.

How it worksAttribution rules in the Income Tax Act prevent certain types of income splitting by attributing income earned on money transferred or gifted to a family member back to the transferor. Similarly, if you lend funds to a spouse the attribution rules can also still apply, in which case any income earned from investing the loaned amount would be taxed in the hands of the higher-income lender.
