Can I Get An Fha Mortgage If I Have Judgments Collections And Federal Tax Liens

Yes, you can get an FHA mortgage if you have collections items outstanding. Prior to July 1, 2012, the FHA had discussed a limit on such collections, proposing that an applicants credit report must not show more than $1,000 in aggregate debt collection. That plan was scrapped before implementation, however.

There are no dollar limits for items in collection on an FHA mortgage applicants credit report.

Applicants with outstanding judgments and/or federal tax liens, however, wont have much luck. The agency requires that all judgments be paid-in-full and that all federal tax liens be resolved prior to closing on an FHA-insured mortgage.

Don’t Reactivate The Account

Collections are serious delinquencies and damage your FICO score heavily. However, the harm diminishes over time. Settling an old collection or starting a payment plan makes it appear new again to credit bureaus, and you can actually drop your score.

How should you deal with an old collection? First, do not talk to any bill collector who contacts you about an old debt. You don’t want to accidentally restart that clock. Request documentation proving that you owe the debt and indicating that the collector is authorized to collect it. State plainly that you do no acknowledge the debt as yours. If you want to pay the debt in full or start a repayment plan, youre probably better off negotiating with the original creditor.

Contact them first about paying the debt and removing the negative notations from your credit report. If they refuse to deal with you, send a letter to the collection agency. You can find good sample letters online that you should be able to adapt for this purpose.

Dont tell the creditor that youre trying to get a mortgage. That puts you in a weak negotiating position.

Get the agreement in writing. Ideally, a letter to you from the creditor confirming that it owns the debt, detailing the agreement and promising to remove the collection and charge-off from your credit history.

Alternatively, send the creditor a letter explaining the agreement you want and asking them to sign and return it before you send them any money. Forward a copy of the signed letter to the collection agency.

Can I get an FHA loan with a collection in my credit history? The answer can be complex since no two credit histories are alike, but there are some general guidelines that can help you understand where you might be in terms of the ability to get a home loan approved even with a collection in your credit record.

It should be understood that what follows are the FHA guidelines for the loan approval process in terms of dealing with a credit issue lender standards may also apply above and beyond these rules.

HUD 4000.1 has the rules for lender requirements when processing a loan with collections in the borrowers credit history. The rules start out by describing what the FHA considers a collection.

A Collection Account refers to a Borrowers loan or debt that has been submitted to a collection agency by a creditor.

According to HUD 4000.1, in situations where the borrowers credit reports show cumulative outstanding collection account balances of $2,000 or greater, the lender is required to do the following:

-verify that the debt is paid in full at the time of or prior to settlement using acceptable sources of funds

-verify that the Borrower has made payment arrangements with the creditor and include the monthly payment in the Borrowers DTI or

-if a payment arrangement is not available, calculate the monthly payment using 5 percent of the outstanding balance of each collection and include the monthly payment in the Borrowers DTI.

Fha Loan With A Car Repossession

My husband and I are qualified in every aspect for a conventional loan, except for one problem. There is an unpaid voluntary car repossession on my husbands credit report dated back to 2009. Our LO advised to just wait until it drops off in about 18 months but we are wanting to try everything possible to get into a home before then.

The repossession has a balance of 10,000, does anybody know of any options to get this taken care of other than paying the balance in full? Also, would we qualify for an FHA mortgage loan with this repossession? Its not a judgement either.

How Fha Credit Requirement Compares To Other Mortgages

FHA loans are really the only mortgage for people with bad credit. Unless youre a veteran, eligible for a VA loan which typically has a minimum credit score needed between 580 and 620 depending on the mortgage lender. All other loans require at least a 620 FICO score to qualify.

Borrowers with substantial unpaid collection accounts, HUD guidelines on collection accounts can pose a problem. Even though borrowers do not have to pay outstanding non-medical collections off to qualify for an FHA loan, large collection account balances can pose a debt to income ratio problem. We will explain the potential problems high outstanding collection balances can pose when qualifying for an FHA loan:

Remember that lenders will now require that 5% of the unpaid non-medical collection balance to be used towards calculating borrowers debt to income ratios:

  • A $20,000 unpaid collection account will add an additional $1,000 towards monthly expenses and likely disqualify borrowers
  • The good news is if in this situation, HUD allows borrowers to set up written payment agreement with creditor and use the monthly written payment agreed upon towards calculating the debt to income ratios in lieu of the 5%
  • On the $20,000 unpaid collection issue, if the borrower sets up a written payment agreement with creditor of $50.00 per month for so many years, then the $50.00 payment will be used towards the monthly expense
  • The $50 dollars per month agreed upon payment agreement with the creditor will be used instead of the 5% of the $20,000, or $1,000 per month
  • There is no seasoning requirements to this rule
  • As long as the payment agreement is into effect, the mortgage lender will use them

Is It A New Past

Past-due accounts go to collection when you stop making payments. For instance, if you charge up a credit card and then default on the account. Your creditor will send letters and probably call you. If it can’t get you to pay up, the card issuer either hires a collection agency and pays it a percentage of whatever it collects from you, or it sells your account and the right to collect your debt to an agency.

Non-medical collections can also incur interest and collection costs and fees. Your credit card interest rate may skyrocket for missing a payment, and then the card issuer or collection agency gets to apply that rate to your unpaid balance.

Past-due accounts can do more damage because your credit history may take several hits. First, there are the missing payments to the original creditor. Then there is the collection itself, which can be reported immediately. And finally, if the agency sues you for payment, you’ll have a judgment – a public record.

Fha Credit History Standards

Your credit score is just a three-digit number. Your credit history details your payments for each of your debt accounts.

Lenders look for red flags in your credit history that might indicate you will not repay the loan. Occasional, infrequent late payments on a credit card, for example, will not raise a concern if you can explain why they occurred.

Collections and late payments are evaluated on a case-by-case basis. Lenders may overlook occasional late payments on your cable bill or clothing store credit card. A serious delinquency in these types of accounts would reflect negatively on your credit score. However, lenders are more concerned about late payments on your rent or mortgage. Lenders see a history of late rent and mortgage payments as a sign you may default on future home loans.

If you defaulted on a federal student loan or have another unpaid federal debt, you will be required to come up to date and have the debt either paid off in full or be current for several months. Similarly, judgments against you must be paid. Sometimes credit issues are beyond your control. The FHA realizes this and creates programs that take into account how one’s credit history may not reflect that person’s true willingness to pay on a mortgage.
