Whats Changing For Daca Recipients
HUDs latest announcement doesnt change DACA FHA eligibility. However, it does clarify the documents that non-permanent residents can use to qualify for those loans.
Heres a full look at the eligibility requirements non-residents must meet, as well as the documents they can use to prove that eligibility:
- The buyers must use the property as a primary residence not a second home, vacation house, or investment property.
- They must have a valid Social Security Number unless employed by the World Bank, a foreign embassy, or an equivalent employer
- They must be eligible to work in the U.S. and have one of the following:
- An Employment Authorization Document showing their current work authorization status
- A USCIS Form I-94 showing their H-1B status, plus evidence of employment with an authorized H-1B employer for at least one year
- Evidence of refugee or asylee status granted by the USCIS
- Evidence of citizenship in Micronesia, the Marshall Islands, or Palau
If a borrowers Employment Authorization Document is set to expire within the year, the lender will need to determine how likely it is that authorization will be renewed. They may use past renewals as a guideline or, if those are unavailable, work with USCIS directly.

Other Home Loan Options For Dreamers
We already mentioned that some lenders of conventional loans consider applications from Dreamers.
Fannie Maes conforming loans are also open to those in the DACA program.
Most mortgage lenders offer loans backed by Fannie Mae, and these include a wide variety of options like:
- The 3% down Conventional 97 loan
- The 3% down HomeReady loan for low-income buyers
- Loans with less than 20% down WITH mortgage insurance
- Loans with 20% down payment or more and NO mortgage insurance
The situation is less clear for Freddie Mac .
Freddies guidance uses language that was similar to the FHAs old wording. And those who lacked lawful residency status were ineligible. A search of its website on the day this was written revealed no hits for DACA or related terms.
But it may well be that Freddie will soon update or clarify its DACA policies now that the FHA has and now that a new, more Dreamer-friendly administration is in place.
And it would be no surprise if other organizations similarly refined their policies in coming weeks to reflect those factors.

History Of Daca Recipients And Fha Loans
Prior to this year, the FHA handbook included a statement that Non-U.S. citizens without lawful residency in the U.S. are not eligible for FHA-insurance mortgages.
FHA mortgages are among the most accessible home loans out there because of the flexible credit score and low down payment requirements. Generally speaking, borrowers must have a credit score of 580 or higher to qualify with a 3.5% down payment.
But lenders can approve borrowers who dont have a credit score or traditional credit history using other documentation, broadening the scope of who can qualify.
Former HUD Secretary Ben Carson waived the rule against qualifying DACA recipients briefly in June 2020. But then HUD reinstated the policy, once again directing lenders to deny DACA applicants.
On January 19, however, the agency announced it would waive the rule once again and, eventually, strike the line from future handbooks entirely.
The term lawful residency pre-dates DACA and thus did not anticipate a situation in which a borrower might not have entered the country legally, but nevertheless be considered lawfully present, HUD wrote in the January update. To avoid confusion and provide needed clarity to HUDs lending partners, FHA is waiving the above-referenced FHA Handbook subsection in its entirety.

On Wednesday, a federal judge said that the Trump administration’s decision to terminate the Deferred Action for Childhood Arrivals, or DACA, program, was based on the virtually unexplained grounds that the program was unlawful and ruled that the protections must stay in place and that the government must resume accepting new applications. Under Judge Bates ruling, unless the administration can justify its decision within 90 days, the cancellation of the program will be rescinded.

Politics Dreamers And The Mortgage World
DACA became effective in 2012 through an executive order signed by then-President Obama. The Trump administration attempted to end it. During a time of intense political pressure against DACA, the Federal Housing Administration stopped backing DACA mortgages. That left would-be applicants with fewer loan options. But the FHAs stance only held up so long.
The Fair Housing Act prevents real estate professionals,lenders included, from treating anyone differently on account of citizenshipstatus. Under federal law, noncitizens are entitled to buy and financeproperty. This principle was tested in two recent class-action suits againstthe Wells Fargo Bank. In settlements, the bank agreed to change its policiesand pay millions in financial damages after declining credit applications from DACAbeneficiaries because of their immigration status. At issue: rejected applicationsfor auto loans, student loans, credit cards, credit lines, small businessloans, and, yes, home mortgages.
As the class-action suits underscore, citizens andnoncitizens alike are entitled to receive loans if their credit and employmenthistories demonstrate a solid ability to repay. Thus, Fannie Mae did not stoplending to Dreamers. People are legally present in the U.S., FannieMae noted, and eligible to apply, if they hold:
- A Social Security or individual TaxpayerIdentification Number and
- Current work authorization or
- Other documentation of current status, such as agreen card or valid employment visa.
Daca Recipients Again Eligible For Popular Fha Loans
It just got easier and more affordable for Dreamers to buy a home.
Recipients of the federal DACA program, known as Dreamers, can once again apply for FHA loans, according to the Federal Housing Administration.
The program was closed to recipients for three years under the Trump administration. Recently, the FHA reversed that decision. That means Dreamers can access the popular first-time home buyer program that offers a lower down payment than most conventional loans.
Its very exciting. Its a way that a lot of immigrant families start their American Dream, said Jose Patiño, a Dreamer and the director of education and advocacy for the nonprofit Aliento that aids and advocates for Dreamers and undocumented youth in Arizona.
A former loan officer, Patiño said being accepted into DACA allows young adults to obtain credit cards and build credit and that an FHA loan is one of the few ways for immigrants to build wealth.
Its the first step to be able to build wealth, so its such an important opportunity that people are going to be able to have now, said Patiño, 32, of Gilbert.
Before the program was closed in 2018, Patiño and four of his siblings bought homes with an FHA loan and later refinanced them through conventional lenders. His eldest sister recently paid off her loan in full.

Last week, the US Department of Housing and Development made two significant announcements impacting mortgage loans insured by the Federal Housing Administration . First, the FHA announced that, effective January 19, 2021, individuals residing in the United States under the Deferred Action for Childhood Arrivals program who are legally permitted to work in the United States are eligible to apply for FHA-insured mortgages. Second, on January 21, 2020, HUD announced the extension of the foreclosure and eviction moratorium for borrowers with FHA-insured single family mortgages to provide meaningful support to individuals and families struggling to make mortgage payments due to the COVID-19 national emergency. We summarize both developments below.
DACA Recipients Eligible for FHA-Insured Mortgages
On January 20, 2021, the FHA announced that it had issued a waiver in full, dated January 19, 2021, of Single Family Housing Policy Handbook 4000.1 Section II.A.1.b.ii.. That provision states: Non-US citizens without lawful residency in the United States are not eligible for FHA-insured mortgages. The waiver also states that the language from that section will be removed from the Handbook in a subsequent update to the Handbook.

Hud Makes Major Policy Change On Fha Loans For Daca Dreamers
Non-US citizens without lawful residency in the U.S. are not eligible for FHA-insured mortgages. The HUD official site acknowledges that the notion of lawful residency was established prior to DACA, …and thus did not anticipate a situation in which a borrower might not have entered the country legally, but nevertheless be considered lawfully present.
- The property must be the borrowers principal residence.
- The borrower must have a valid Social Security Number , except for those employed by the World Bank, a foreign embassy, or equivalent employer identified by HUD.
- The borrower must be eligible to work in the U.S., as evidenced by the Employment Authorization Document issued by the USCIS The borrower must meet the same requirements, terms, and conditions as those for U.S. citizens.
- An Employment Authorization Document is required to substantiate work status. If the Employment Authorization Document will expire within one year and a prior history of residency status renewals exists, the lender may assume that continuation will be granted.
- A borrower residing in the U.S. by virtue of refugee or asylee status granted by the USCIS is automatically eligible to work in this country. The Employment Authorization Document is not required, but documentation substantiating the refugee or asylee status must be obtained.

Daca Recipients Once Again Eligible For Fha Mortgages

There’s some good news for immigrants covered by DACA.
FHA mortgages are government-insured mortgage loans that aim to make it easier for individuals to buy a home. The government guarantee means lenders are more willing to make FHA loans to borrowers with lower , limited income, or smaller down payments. These loans are available to people with credit scores as low as 500 with a 10% down payment or 580 with a 3.5% down payment.
Unfortunately, a certain group of individuals has been shut out of eligibility for FHA mortgages in recent years. Those individuals are immigrants covered by the Deferred Action for Childhood Arrivals program put in place by President Barack Obama. DACA recipients were brought to the United States as children and must meet certain other qualifying requirements.
The good news is, DACA recipients who are eligible to work in the U.S. are now also eligible to get an FHA mortgage again. This should open up the door to homeownership for millions of individuals.
Can Daca Recipients Get Home Loans
DACA recipients are eligible for home loans, but most likely traditional banks will not approve your application. However, there are alternative options.
One option is a loan from the Federal Housing Administration designed explicitly for Dreamers. There are four requirements to qualify as a non-permanent resident:
- The property you are financing with the loan must be your primary residence.
- You need a valid social security number .
- You need to meet the other general loan requirements for U.S. citizens.
- You need an Employment Authorization Document from U.S. Citizenship and Immigration Services to prove you have permission to work in the United States.
You could also try to get a loan from a private lender. These loans generally have fewer documentation requirements. However, they will probably expect a minimum credit score of 650.
