Interest doesnât stop on a loan when it goes into default. In fact, your interest rate may actually be higher once loan payments are delinquent or in default. Late fees and interest will continue to be added to the amount owed. Additionally, you will be charged the cost of collecting your defaulted student loans. Collection costs can be as much as 17.93% of your loan amount if your loan is held by the U.S. Department of Education. Other loan holders can charge different amounts.

Federal loans are money owed to the U.S. Taxpayer.     They can garnish your wages, take your tax refunds, garnish your Social Security, or go after other federal benefits. They dont need court approval to begin wage garnishment, either, like private loan owners do.

    In fact, the Department of Education issues no public guidelines on settling federal loans because they do not want to encourage anyone to do so.

    However, the Education Department does issue internal guidelines to their contracted collection agencies and guaranty agencies.

    This Department of Education guideline memo to guaranty agencies from 1993 states that guaranty agencies are permitted to compromise or settle the loan under certain conditions and up to certain amounts.

    Those allowable settlement or compromise offers are:

  • Waiver of debt collection fees
  • 50% waiver of interest and fees

    Keep in mind that your loan holder might not agree to a settlement especially if they have other means to collect payments, such as wage garnishment. Additionally, it could be difficult to come up with a lump sum to offer. However, it might be worth asking if you can afford to do so.

    You may seek out a student loan settlement for a number of reasons, though these may differ depending on whether you have federal or private student loans. No two situations are the same, so its wise to investigate the potential for a student loan settlement if your loans are in delinquency but you havent fully defaulted yet.

There are also a variety of forgiveness programs available based on income, disability, and other situations that may be a better financial choice.

    Orderly Payment of Debts

    A borrower whose student loans have been included in a provincial arrangement for the orderly payment of debts may apply for additional Alberta Student Aid funding once they have received their Final Report.

    A copy of the Final Report must be provided as confirmation that the borrower has successfully completed the Orderly Payment of Debts program.

    In Alberta, Money Mentors is the provider of the Orderly Payment of Debts program, a debt consolidation program legislated under the BIA and monitored by the Province of Alberta.

    Bankruptcy or Consumer Proposal

    Under the BIA, if it has been more than seven years since the borrower ceased to be a student when the borrower files for bankruptcy or files a consumer proposal, student loans will be dissolved when the borrower is discharged from bankruptcy or upon completion of a consumer proposal.

    In the case of exceptional financial hardship, a borrower may apply to the Court for a discharge after five years have passed since the borrower ceased to be a student.

    You can get help for federal loans in default by calling Federal Student Aid at 1-800-433-3243. The representative can check the National Student Loan Data System to find your loans and put you in contact with the company handling your account.

    You could also try to find help online. But that can be challenging. There are only a handful of people and organizations that I can recommend based on my knowledge of their skills and experience.

    Default is when a loan isnât paid according to the terms of the loan. There is a difference between a student loan that is delinquent and one that is in default. A student loan is delinquent as soon as a monthly payment is past due, but is not necessarily in default.     The number of days of non-payment for a student loan to move into default depends on the type of loan you received and the terms of your loan.     You have three options to get your student loans out of default:

    Settlement . When you contact the debt collector, the representative will first ask if you want to pay the full amount. If you say no, they will then offer you a settlement to resolve the loan balance in full. The settlement amount, or compromise, will typically waive the collection costs, half of the outstanding interest, and a tiny portion of the principal balance.     Consolidation . If you canât afford to settle, student loan consolidation is the fastest way to dig out of default. The process takes your federal loans and combines them into a new Direct Consolidation Loan. While consolidation wonât lower the interest rate or shave off some of the accrued interest and collection fees, it will clear you from the CAIVRS report and restore your eligibility for student loan forgiveness programs, like the PSLF Program.
