Loan Forgiveness For Defrauded Borrowers

In March 2021, the Education Department announced it would streamline processing for borrower defense claims, which can be submitted by borrowers who have been deceived by their institutions. That announcement and several subsequent rounds of forgiveness have helped more than 100,000 borrowers and totaled more than $2 billion.

The first round of forgiveness of this kind totaled about $1 billion and went to about 72,000 borrowers who attended Corinthian Colleges, ITT Technical Institute, and American Career Institute. Borrowers who attended Westwood College, Marinello Schools of Beauty, and the Court Reporting Institute also earned forgiveness last summer and started receiving automatic discharges for their student loans in September 2021.

Then this February, Biden announced another round of forgiveness for borrowers who attended DeVry University, Westwood College, Corinthian Colleges, Marinello Schools of Beauty, the nursing program at ITT Technical Institute, and the criminal justice programs at Minnesota School of Business/Globe University. About 20% of that round of forgiveness went to DeVry University because the Education Department found that DeVry advertised the school as âCareer Placement Universityâ with a 90% job placement rate. In actuality, though, the schoolâs job placement rate was just about 58%.

Loan Forgiveness For Nurses

Registered nurses, nurse practitioners and members of nursing faculty, who work in high-need population areas or areas where there is a critical shortage could qualify to have up to 85% of their loans forgiven under the NURSE Corps Loan Repayment Program.

Qualified candidates can have 60% of their student loans forgiven for working two years in an underserved area. Another 25% could be forgiven for working three years.

Where Student Loan Forgiveness Currently Stands Under Biden

Since Biden assumed office, student loan borrower activists, a broad coalition of advocacy organizations, and leading congressional Democrats have been pushing him to cancel upwards of $50,000 in student loan debt for every borrower using executive action. Many activists have framed the issue as a matter of racial justice, in light of the fact that borrowers of color and Black borrowers in particular rely more heavily on student loan debt relative to their White peers, and have more difficulty repaying it.

While Biden has expressed support for some sort of broad student loan forgiveness, he has called on Congress to pass student loan forgiveness legislation. That has not happened, however, and there are no signs of imminent Congressional action on student debt, as the House and Senate focus on voting rights legislation and Bidens stalled economic agenda.

While Biden campaigned on forgiving $10,000 in federal student loan debt for borrowers and championed other student loan forgiveness initiatives as well, he has expressed uncertainty that there exists a sufficient legal basis to act without Congress. He has also expressed downright opposition to larger amounts of student loan forgiveness that advocates and congressional Democrats have called for.

Most people wont qualify for loan forgiveness as the system now stands, whether through IDR or other programs such as Public Service Loan Forgiveness, designed to help people who work for the government and non-profit organizations. Are Student Loans Being Forgiven After 10 Years

In order to have your student loan forgiven after a 10-year period, some of the requirements that need to be met are as follows:

  • You must be working full-time for the government or an eligible non-for-profit in a certain field, like firefighting, teaching, government, nursing, public interest law, military, or religious work
  • You need to have made payments for 10 years, totalling 120 payments for the full amount inside 15 days of the date the monthly payments goes out.
  • You need to have a loan in the federal direct loan program, although you can consolidate your federal loans as one payment as part of the PSLF.

However, some of the type of players that do not qualify for the PSLF include labour unions, partisan political organizations, and for-profit organizations, which includes for-profit government contractors.

Most federal student loan borrowers don’t have to pay their bills until May, and during that time interest is suspended, thanks to pandemic-era relief.

Since $10,000 in student loan forgiveness is the proposal most likely to turn into reality, Betsy Mayotte, president of The Institute of Student Loan Advisors, a nonprofit, said she sees nothing wrong with people who owe under that amount redirecting their usual payments to savings until we hear more about forgiveness.

Even if you owe more than $10,000, it can still be wise to take advantage of the government’s pause on student loan payments.

You can use the extra cash to wipe out high-interest credit card debt, for example, or to build up your emergency savings.

Student Loan Forgiveness Alternatives

The qualifying standards for student loan forgiveness eliminates many of the 45 million borrowers, but there are other avenues to pursue that might make repaying your debt a little less challenging.

The most obvious one for federal loans is to sign up for one of the income-based programs. These programs adjust your monthly payment based on your income, so if youre not making much, you arent required to pay much.

The historically low interest rates in 2020 were a prime time for borrowers to examine whether refinancing their student loans made sense. Some borrowers were able to get rates at 3% APR and that reduced their monthly payment to a manageable level. Be aware, however, that if you refinance a federal student loan, you will lose the many options federal programs offer.

If your money crunch is temporary, you can ask that your loans be deferred or place in forbearance. This allows you time to reorganize financially so you can meet monthly payment responsibilities.

Popular Arguments Against Student Debt Cancellation

  • Student debt cancellation is inherently unfair. Critics argue those who didnt go to college or those who already paid off their student loans would not benefit from student debt cancellation.
